This Privacy Policy describes how Espitia Digital LLC (“Espitia Digital,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you visit espitiadigital.com (the “Site”), contact us, or inquire about our web design and digital services. By using the Site or submitting information to us, you acknowledge this Policy. Our Terms of Service also apply.
1. Who We Are
Espitia Digital LLC is a Florida limited liability company based in Weston, Broward County, Florida. We provide custom website design, development, and related digital services primarily to businesses.

2. Scope of This Policy
This Policy covers personal information we collect through the Site (including our contact form), email, WhatsApp, phone, or other channels when you communicate with us about our services.
It does not cover websites, apps, or services we build for clients after handoff—those are governed by each client’s own privacy practices. It also does not cover third-party sites linked from our Site (including WhatsApp), which have their own policies.
3. Information We Collect
Information you provide: When you use our contact form, we collect your name, email address, business name (if provided), and message content. Your message may include social media handles, links, project details, or other information you choose to share. If you contact us by email or WhatsApp, we collect the information you send and related conversation details.
Information collected automatically: Like most websites, our hosting and infrastructure providers may automatically process technical data such as IP address, browser type, device/OS information, approximate location derived from IP, pages viewed, timestamps, referring URL, and diagnostic or security logs needed to operate and protect the Site.
We do not currently operate a separate marketing analytics pixel or advertising tracker on the Site. If we add analytics or advertising tools later, we will update this Policy to describe them.
4. How We Use Information
We use personal information to: respond to inquiries and quote requests; prepare proposals and communicate about projects; deliver and support our services; operate, secure, and improve the Site; prevent spam, fraud, and abuse; maintain business and tax records; and comply with applicable law.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
5. How We Share Information
Service providers / processors: We share information with vendors that help us run our business, only as needed to provide their services. Currently this includes: (a) Resend (email delivery for contact-form submissions); and (b) our website hosting/infrastructure provider (for example, Vercel) for hosting, delivery, and related logs. These providers process information on our instructions and under their own privacy and security terms.
Legal and safety: We may disclose information if required by law, subpoena, or court order; to investigate or prevent fraud, security incidents, or illegal activity; or to protect the rights, property, or safety of Espitia Digital, our clients, or others.
Business transfers: If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, personal information may be transferred as part of that transaction, subject to appropriate confidentiality protections.
With your direction: We may share information when you ask us to (for example, introducing you to a recommended vendor).
6. Cookies and Similar Technologies
The Site and our hosting provider may use cookies, local storage, or similar technologies that are necessary for security, performance, load balancing, or basic site functionality.
You can control cookies through your browser settings. Blocking certain cookies may affect Site functionality. Because we do not currently run third-party advertising cookies on the Site, we do not display a separate advertising-cookie consent banner at this time.
7. Data Retention
We retain inquiry and project-related information for as long as reasonably necessary to respond to you, perform services, maintain business records, resolve disputes, and meet legal, tax, or accounting requirements. Retention periods vary by record type and context.
Technical logs maintained by hosting providers are typically kept for shorter operational periods according to those providers’ settings and practices.
8. Security
We implement reasonable administrative and technical safeguards appropriate to the nature of the information we handle (for example, HTTPS transmission and access-limited systems). No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
If we become aware of a security incident involving personal information that requires notice under applicable law—including Florida’s Information Protection Act (Fla. Stat. § 501.171)—we will investigate and provide any required notifications.
9. Your Choices and Requests
You may request access to, correction of, or deletion of personal information we hold about you, subject to legal exceptions (for example, records we must keep for tax, contract, or legal compliance). Email support@espitiadigital.com with “Privacy Request” in the subject line and enough detail for us to verify and locate your information. We will respond within a reasonable time.
You may opt out of non-essential marketing emails by contacting us. Transactional or service-related messages about an active inquiry or project may still be sent as needed.
Depending on where you live, additional privacy rights may apply under state or international law. We will consider applicable requests in good faith even where a particular statute does not formally cover our business size or revenue.
10. International Visitors
We are based in the United States. If you contact us from outside the U.S., your information will be processed in the United States, where privacy laws may differ from those in your country. By submitting information, you understand that transfer.
11. Children’s Privacy
The Site and our services are directed to businesses and adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact support@espitiadigital.com and we will delete it.
12. Florida and Other Legal Notes
As a Florida business that collects personal information, we take data security and breach-response obligations seriously under Florida law. The Florida Digital Bill of Rights generally applies only to very large controllers and does not currently apply to Espitia Digital based on our size; this Policy is provided for transparency and fair business practices under applicable federal and Florida consumer-protection standards.
If our practices change (for example, adding analytics, CRM tools, payment processors, or advertising pixels), we will update this Policy to reflect those changes.
13. Changes to This Policy
We may update this Privacy Policy from time to time. The “Last updated” date at the top shows the latest version. Material changes will be posted on this page. Continued use of the Site after an update means you acknowledge the revised Policy.
